      摘要:体育惩戒是中外普遍存在的一种教育性惩戒手段。当代社会对学校惩戒教育矫枉过正,使学校德育实践陷入困境。为丰富学校德育理论,文章采用文献研读与逻辑分析等方法,通过对中外体育惩戒相关研究梳理发现:尽管缺乏相关教育法理支持,体育惩戒仍是当今世界普遍存在的教育或管理手段之一。相比,我国对体育惩戒的相关研究尚未形成专门的研究领域。进一步基于对惩戒教育的人性论及道德本位理论基础解读,对学校体育惩戒的合法性及运用原则作一探讨。研究认为,学校教育离不开合理的惩戒辅佐,在当前学校惩戒教育面临危机的背景下体育惩戒是一种相对理想的惩戒教育形式,体育惩戒的运用要遵循按约惩戒、兼顾惩戒的主体性价值与主体间性价值、兼顾惩戒标准的统一性与差异性、轻惩重戒、不附带人格侮辱、惩“恶”不惩“笨”等运用原则。以期为学校教育相关实践提供理论指导,并引起更多关于体育惩戒相关问题的专门和深入研究。

      Abstract: Having students do exercise as punishment is a kind of prevalence educational punishment method at home and abroad. Present criticism on educational punishment has exceeded proper limits and put our moral education practice into a jam. To enrich school moral education theory, this paper analyzed the relative studies at home and abroad by the methods of literature review and logic analysis. We found that despite lack of relative legal support, exercise as punishment is still one of the world’s most prevalence education or administrative mean. In comparison, our researches about “exercise as punishment” problem are not enough to form a specific research field. Then the paper discussed the validity of “exercise as punishment” in school education and its some application principles in practice based on its human nature and moral standards understanding. Conclusions: Proper punishment is necessary for school education and doing exercise can serve as ideal educational punishment when other educational punishment means are not appropriate. The application principles include punishing according to convention, taking into account both subjective value and inter-subjective value when punishing, creating a balance between uniformity and diversity in penalty measurement, attaching more importance to warning function of punishment not to punishment itself, without personality insult in punishment, using punishment in moral education but not in intellectual education. This paper aimed at providing a theoretical reference for school education practice and, in addition, causing more valuable researches about “exercise as punishment” problem.
